Egypt leader Mursi backs down in row with prosecutor

President Mohammed Mursi of Egypt has agreed to allow the Mubarak-era chief prosecutor to keep his job after an embarrassing public row.

Spokesmen for Mr Mursi and the prosecutor, Abdel Maguid Mahmoud, confirmed an agreement had been reached at talks in the capital, Cairo.

Mr Mahmoud earlier returned to work, escorted by judges and lawyers.

He has been criticised for acquitting officials accused of attacking protesters under Hosni Mubarak.

The acquittals sparked violent protests in Tahrir Square in Cairo on Friday when supporters and opponents of President Mursi clashed.

More than 110 people were injured in the worst violence seen since he took office at the end of June.

Saturday's outcome is a big defeat for Mr Mursi, who until now has been steadily consolidating power, says the BBC's Jon Leyne in Cairo.

Under the old government, there was often criticism that judges and prosecutors were susceptible to government pressure. Our correspondent says they are now fighting hard to assert their independence from the new government.

'Unless I am assassinated'

Mr Mahmoud's return to his office on Saturday was a symbolic display of independence, after President Morsi tried to remove him by appointing him ambassador to the Vatican, our correspondent says.

A number of judges reportedly threatened to resign as well.

The chief prosecutor vowed to serve out his term, telling reporters: "I occupy this office and I will defend myself, and I will defend my position, and I will defend the independence of the prosecutor general, and the independence of the judges, and I will not leave this office unless I am assassinated."

The prosecutor went on to a meeting with one of the vice-presidents, in an attempt to defuse the situation.

Mr Mahmoud's deputy, Adel Said, said later that the chief prosecutor and President Mursi had met and agreed that he would stay in office.

There had been a "misunderstanding" over Mr Mahmoud's nomination to the Vatican, Mr Said was quoted as saying by state TV.

Vice-President Mahmoud Mekki confirmed for reporters that Mr Mursi had agreed to keep Mr Mahmoud in his post.

Two protests will be held on Friday in Tahrir Square by two different sets of political forces, Islamists and non-Islamists, with two different sets of demands

Egyptian political parties and movements announced a couple of weeks ago that they will organise what they believe to be the first true million-man protest after the presidential elections in Egypt, uniting non-Islamist forces and political parties in Tahrir Square. Still, with the latest court verdict in the "Battle of the Camel" trial and calls from the Muslim Brotherhood (MB) and other Islamist parties for protesting in the same place, it seems there will be two protests with two sets of different demands. 

The call to protest on 12 October 2012  was initially launched by liberal, leftist and nationalist parties right after the end of President Morsi's 100 days as what they called "Accountability Friday". The protest will  include several marches from different starting points in Cairo and Giza that will meet by afternoon in Tahrir Square. Its principal demand according to a joint statement published on Tuesday is a constituent assembly representing all Egyptians; it also stresses setting minimum and maximum wages and a decrease in the price of basic commodities.

The parties, groups and movements who initially announced they would be participating in the protest are: the National Association for Change, the Popular Egyptian current, the Constitution Party, the Egyptian Social Democratic Party, the 6 April Movement, the Democratic Movement, the Democratic Revolutionary alliance (the Egyptian Socialist Party, the Egyptian Communist Party, the Socialist Popular Alliance Party, Al Tagammu Party, The Workers and Peasants Party, the Socialist Youth Union, the Popular Democratic Movement, the Mina Daniel Movement, the Popular Revolutionary Movement, the for Justice and Freedom and the Peaceful Front for Change.

The Egyptian Democratic Workers Conference, an umbrella for a number of independent trade unions established after the ouster of Mubarak in February 2011, also issued a statement of other demands related more specifically to workers rights, calling for a march to Tahrir square at noon.

Independent activists also announced their support and participation. Prominant activist and blogger Alaa Abdel Fatah told Ahram Online that he is participating in the protest "because I want to protest the continuing brutality of police forces against civilians in police stations, which goes on just as before the revolution". In the past few weeks there were reports accusing police forces of torturing civilians, sometimes to death, in police stations across the country. 

These original protests were not welcomed or supported by the MB, members of which mocked and attacked their instigators, describing their intentions as an attempt to subvert the progress President Mohamed Morsi has been making against the will of the people who had elected him. But after the court ruling acquitting all 24 defendants in the "Battle of the Camel" trial, the MB called on its members across the country to rally against the verdict starting on Thursday – in order to furnish President Morsi with public support for as yet unknown decisions regarding the judiciary in Egypt. The acting president of the Freedom and Justice Party and leading member of the MB Essam Al-Arian also called on members of the party to join the protests. "I call on all the young members of Freedom and Justice to participate in the marches planned on Thursday with the people and the million man protest to achieve justice and retribution," he said on twitter.

The swift decision of the MB to hit the streets at the same time and in the same place as non-Islamist forces have been thought of as an attempt to sabotage an essentially ant-Morsi and anti-Freedom and Justice demonstration. Worth mentioning in this regard is that the Constitution Party officially instructed its members on Thursday not to use anti-Morsi or anti-MB slogans and chants, on the premise that the protest is not about groups or persons but rather demands. Few have been hiding their criticism, however. Ahmed Khairy, for example, spokesperson for the liberal Free Egyptians Party, wondered on twitter how it is that the MB is calling for protests when they are no longer in the opposition. "The call of the MB to protest tomorrow is laughable; the MB should realise that they are now ruling the country, we are the ones who should make demands and they are the ones who should implement them if they want to."

Nor is the MB only Islamist power heading to Tahrir on Friday. Al Gama'a Al Islamiyaa announced, in a statement issued on Thursday, that its members will join the protests in Tahrir Square and other public squares in Egypt. The group  demands re-trials for the murderers of the revolutionaries based on the evidence found by the fact-finding committee formed by the president. The famous Islamist group also demanded that the officials responsible for hiding evidence in the case resign from their posts. The Islamist Al Wasat Party also called on its members and supporters to protest on Friday in order to put an end to what the party believes to be "complicity with the revolutionaries' murderers". The party demanded that President Morsi should issue the new law of the judiciary authority hoping that it would pave the road towards an independent judiciary system.                                          

For its part the 6 April Youth movement-Ahmed Maher front announced that it would be participating in the Thursday and Friday protests, contrary to its initial decision not to participate. In media statements earlier this week, Mahmoud Afify, spokesperson for 6 April, said that the movement would not participate in the protests of 12 October even as it fully respects the decision of those movements and powers protesting. "We held an in-house poll to find out if the members are ready to participate in the protest and the results came against the participation," he said, adding that the current time is not ideal for holding protests against the government and the regime. This position had enraged activists who already suspected 6 April was in the employ of the MB and the president. In their defense Mohamed Adel, former spokesperson for 6 April and leading member, said on twitter, "We want to make it clear that the MB began to mobilise their members only after of 6 April Youth movement called on its members to join the Friday protests and demand the purging of both the judiciary and the Ministry of Interior". 

Expecting a high turnout of protesters and preparing for a big day and the possible return of huge protests to Tahrir Square, the Ministry of Health announced on Thursday that it will send over 40 ambulances there.  Anything is possible.

Former parliamentary speaker Fathi Sorour, who was among 25 defendants acquitted on charges related to the Battle of the Camel on Wednesday, will remain in jail on other charges.

A judicial source at the Illicit Gains Authority has said new evidence has emerged about Sorour's fortune, which may have been obtained illegally.

It was reported earlier on Thursday that Sorour, who has been detained at Tora Prison with other Mubarak-era officials, had changed out of his prison uniform and was due to be released.

Judge Safwat Towra, the head of the Investigations Authority, had ordered Sorour's release in May 2011 on LE200,000 bail while the corruption investigation continued. However, Sorour remained in prison due to charges relating to his alleged role in the Battle of the Camel.

The source added that most of the other defendants in the 'Camel' case would also remain in custody on other charges.

Safwat El-Sherif, former secretary-general of the now-defunct National Democratic Party (NDP), will remain in prison because he is still being tried for corruption. He is accused of illegally obtaining some LE300 million (roughly $49.2 million) during his long Mubarak-era political career. El-Sherif's two sons, Ashraf and Ihab, face similar charges.

The Cairo Criminal Court on Wednesday acquitted all 25 defendants of involvement in the Battle of the Camel during the Egyptian Revolution.

The battle left 11 dead and over 600 injured in Tahrir Square on 2 February 2011. It was allegedly orchestrated by members of the Mubarak regime in an attempt to end the mushrooming uprising against its rule. However, it gave the revolution momentum to bring a swift end to Mubarak's 30-year rule less than two weeks later.

Prosecutors began arresting suspects believed to have orchestrated the battle shortly after Mubarak's ouster on 11 February 2011. Around 25 figures associated with the former ruling NDP were arrested, including Safwat El-Sherif, Fathi Sorour, former minister of manpower Aisha Abdel-Hadi and former MP and businessman Mohamed Abul-Anin.

Egypt's governors' council has set strict new closing times for shops and restaurants due to the country's "current security and economic condition," the state-run MENA news agency reported on Thursday.

Under new laws to be enforced in November, Egypt's shops will have to shut their doors by 10pm, while restaurants will have to close by midnight.

 

Speaking to MENA, local development minister Ahmed Zaki Abdeen warned of harsh penalties for violators but said that business owners who wish to keep their premises open later could apply for a licence from the Ministry of Tourism.

 

Establishments classed as catering to tourists, as well as pharmacies, will be allowed to operate as normal.

 

Enforcing closing times for businesses was suggested in August by petroleum minister Osama Kamal, then tackling persistent power outages, who said it would reduce Egypt's energy consumption.

 

The move was welcomed by Elhamy El-Zayat, the head of Egypt's Federation of Tourism Chambers, who said it would trim the number of unlicenced street vendors.

 

"Shops will turn off their lights by 10pm. That will mean customers won't be milling around the main streets and illegal vendors will give up," he told Ahram Online.

 

El-Zayat said the decision would have no real impact on tourists, adding that around 1,500 restaurants have licences from the Ministry of Tourism and will be exempt from the new hours.

 

New legislation may encourage other businesses to register, he said, allowing the ministry to monitor their services.

 

"Owners of these establishments are obliged to pay 10 per cent sales tax to the Ministry of Tourism which will push up public revenues too," he said.

Egyptian President Mohamed Morsi directed his government to issue a new law for the protection of the revolution, announced the director of the president's office Ahmed Abdel-Ati during a press conference on Thursday evening.

Morsi had met with top officials including Vice President Mahmoud Mekki, Prime Minister Hesham Qandil, Defence Minister Abdel Fattah El-Sisi and Justice Minister Ahmed Mekki earlier in the day, after which he made the decision to remove the unpopular Prosecutor General Abdel-Meguid Mahmoud.

The revolution law aims to "safeguard the gains of the revolution" and to hasten procedures to effect retribution and justice for the martyrs and the injured of the 25 January revolution and subsequent clashes, Abdel-Ati said, stressing that it would strive after balance a between prompt justice and the rule of law.

Senior Mubarak-era figures were acquitted on Wednesday by the Cairo Criminal Court for their role in the infamous "Battle of the Camel" attacks on protesters during the brief 18-day uprising which ousted Mubarak. The acquittal has caused much public anger and gave momentum to already planned protests on Friday.

CAIRO — An Egyptian court on Wednesday acquitted 24 loyalists of ousted President Hosni Mubarak who had been accused of organizing one of the most dramatic attacks on protesters during last year’s uprising, the “Camel Battle,” in which assailants on horses and camels charged into crowds in Cairo’s Tahrir Square.
The 24 were found innocent on charges of manslaughter and attempted murder. The defendants included some of the biggest names of Mubarak’s regime, including the former parliament speaker and the head of the now-dissolved ruling party, along with government ministers and businessmen. A 25th defendant died during the course of the trial.

 أشادت صحيفة "فبروست" البولندية، اليوم الثلاثاء، بقرار الرئيس الدكتور محمد مرسى بالعفو عن جميع المعتقلين فى أعقاب ثورة 25 يناير.

 

 

وقالت الصحيفة، تحت عنوان: "مصر تعتذر لمعارضى مبارك "، "إن قرار الرئيس مرسى سيشمل الآلاف ممن قادوا الاحتجاجات العام الماضى أثناء وبعد ثورة 25 يناير، والذين ساهموا بشكل كبير فى إسقاط نظام الرئيس السابق حسنى مبارك، على حد وصف الصحيفة.

 

 

وذكرت الصحيفة "أن العفو سيشمل كل المعتقلين اعتبار من يناير 2011 إلى يونيو 2012، حين تولى الرئيس مرسى مهمام السلطة"، مشيرة إلى أن الاستثناء الوحيد من هذا العفو للأشخاص الذين تورطوا فى جرائم قتل.

 

 

ووصفت الصحيفة قرار العفو بأنه قرار مدروس، وأخذ وقتا من التحضير، كما أنه سيساهم فى تخفيف حدة الاضطرابات الاجتماعية فى البلاد التى تفاقمت عقب ثورة 25 يناير، إلا أن المطالب الفئوية والصعوبات الاقتصادية ما زالت تمثل العبء الأكبر على الحكومة المصرية الجديدة.

 

 

ووصفت الصحيفة مصر بأنها أبرز دول الربيع العربى، والتى نجحت ثورتها السلمية فى 18 يوما فى إزاحة نظام استبدادى حكم البلاد لمدة 30 عاما، وقدمت مصر رئيسها السابق إلى محاكمة عادلة، أسفرت عن الحكم عليه بالسجن المؤبد بعدما تورط، حسب الصحيفة، فى وقائع فساد وقتل لأكثر من 850 من المتظاهرين السلميين.

تنظر الدائرة الأولى بمحكمة القضاء الإدارى بمجلس الدولة صباح غدٍ الثلاثاء الدعوى المقامة من المستشار مروان الحداد المستشار بهيئة قضايا الدولة والتى يطالب فيها بوقف تنفيذ القرار الإدارى الصادر عن لجنة الصياغة بالجمعية التأسيسية للدستور لما حوته من صياغة نصوص جديدة للسلطة القضائية غير النصوص التى وردت إليها من لجنة نظام الحكم.

وطالب الحداد بإلزام لجنة الصياغة بعرض النصوص الواردة لها من لجنة نصوص الحكم دون غيرها على الجلسات العامة للجمعية التأسيسية.

أمر المستشار ثروت حماد، قاضي التحقيق المنتدب من وزير العدل، اليوم الإثنين، بإخلاء سبيل الإعلامية هالة سرحان ومسئولي قناة روتانا، من دار القضاء العالي، بضمان بطاقاتهم الشخصية على ذمة التحقيقات، في شأن بلاغات قضائية تتهمهم وآخرين بإهانة السلطة القضائية.

وأنكرت هالة سرحان وبقية من تم سؤالهم بالتحقيقات اليوم، أن يكون مقصدهم من المواد الإعلامية التي تناولت الشئون القضائية، هو الإساءة للسلطة القضائية أو لرجال القضاء.

ويباشر المستشار ثروت حماد، التحقيق في البلاغات التي تقدم بها 1064 قاضيًا ضد بعض الصحفيين والإعلاميين والقنوات الفضائية التي دأبت على إهانة رجال القضاء.

وكان المستشار أحمد مكي، وزير العدل، قد قرر ندب المستشار ثروت حماد، الرئيس بمحكمة استئناف القاهرة، وعدد آخر من القضاة لمباشرة التحقيقات في تلك البلاغات التي تقدم بها قضاة ضد عدد من الإعلاميين والصحفيين.

لم تكن "نيفين"، المسيحية الديانة، تعرف وهي تشرح درس نشأة الرسول محمد ومولده، صلي الله عليه وسلم، بكتاب الدراسات الاجتماعية للصف الثاني الإعدادي أن الأمر سينتهي بها إلى القبض عليها بتهمة ازدراء الأديان.

يتمثل منهج الدراسات الاجتماعية الذي تشرحه ميس نيفين وغيرها من مدرسي مادة الدراسات الاجتماعية في وحدتين الأولي "حياة محمد صلي الله عليه وسلم.. قصة بناء أمة" والوحدة الثانية "الخلفاء الراشدون"، كانت نيفين تشرح لـ40 طالبا بمدرسة نزلة عبداللاه المشتركة بمدينة أسيوط الدرس المكلفة به.

يحكي أحد أقارب المدرسة "نيفين نادى جاد السيد"، أنه تم القبض أمس علي نيفين، إثر قيام الطالب محمد مصطفي هشام بتوجيه تهمة ازدراء الأديان لها، وأنه تم تهديد بيت نيفين كله بأنه سيتم حرقه، مما اضطرهم لمغادرته والإقامة عند أقاربهم خارج أسيوط.

وبقي زوجها وأحد أقاربها أمام قسم الشرطة، قلقين علي صحة نيفين لأنها "حامل".

ويحكي قريبها - الذي طلب عدم ذكر اسمه لخوفه من التعرض لضرر- : "كان الفصل به 40 طالبا ومع ذلك قام طالب واحد فقط بتحرير المحضر ضد نيفين، وتم تحويلها للتحقيق بتهمة الإساءة للرسول".

وحكي قريب نيفين كيف أنهم ظلوا يبحثون بالأمس عن محام يحضر معها التحقيقات، وكلما عرف المحامي أن التحقيق في ازدراء أديان كان يرفض.

أضاف قريب نيفين أنه تم إخلاء سبيلها علي ذمة القضية، وحاولنا الحديث معها أو زوجها، لكنهما رفضا الحديث بكل خوف وذعر، فلم تكن تتخيل نيفين أن شرحها لأحد دروس مادتها سينقلها من الفصل إلي قسم الشرطة، قبل الإفراج عنها وإخلاء سبيلها على ذمة القضية.

مصادر قضائية: «الكسب غير المشروع» لا يستطيع التحقيق مع عنان

قال مصدر قضائى رفيع إن البلاغات التى تمت إحالتها لجهاز الكسب غير المشروع المتعلقة بالفريق سامى عنان لن يتم التحقيق فيها بالجهاز، ولكن سيتم إحالتها للقضاء العسكرى باعتبارها الجهة المخول لها التحقيق مع العسكريين المتقاعدين والحاليين فى قضايا الكسب غير المشروع.

 

ونفى المصدر أن يكون قرار الإحالة جاء بسبب إقامة أحد المحامين دعوى قضائية لإلغاء التعديلات التى تم إدخالها على القانون خلال المرحلة الانتقالية، مستندا إلى عدم دستورية نص المادة 8 مكرر «أ» من قانون الكسب غير المشروع للعسكريين، مؤكدا على أن النيابة العامة ملتزمة بالقانون القائم ما لم يتم تعديله.

 

وأوضح أن سبب الإحالة الروتينية للكسب غير المشروع هو وجود اسم المهندس محمد إبراهيم سليمان وزير الإسكان الأسبق فى البلاغ الذى يتهم الفريق سامى عنان رئيس أركان حرب القوات المسلحة السابق، باستغلال منصبه للحصول على أراض فضاء وفيللتين بمنطقة مارينا وقصر بمنطقة سيدى كرير بطرق غير مشروعة بمساعدة الوزير الأسبق.

 

فى السياق ذاته، أحال النائب العام بلاغ قدمه أحد المحامين ضد اللواء هتلر طنطاوى رئيس هيئة الرقابة الإدارية الأسبق إلى إدارة الكسب غير المشروع أيضا، حيث اتهم البلاغ طنطاوى بالاستيلاء بطريقة غير شرعية على أراض شاسعة فى مناطق عدة، وقصر فخم فى التجمع الخامس تم بناؤه بالمخالفة للقانون، وعقار من أربعة طوابق وقصر فى مارينا وقصر فى قرية بدر المجاورة لمارينا وفيلتان فى 6 أكتوبر.
